Supreme Court Upholds Travel Ban

On April 25, 2018, the Multifaith Alliance for Syrian Refugees (MFA) joined immigrant rights groups and activists outside the Supreme Court as oral arguments in Trump v. Hawaii began to decide if the executive order violates federal law.

The Supreme Court today in a 5-4 decision affirmed the President’s right to issue a sweeping indefinite travel ban on individuals from certain countries. The ban while including North Korea and Venezuela is clearly targeted at Muslims, since the other countries falling under the ban have Muslim majorities. These are: Syria, Libya, Yemen, Somalia, and Iran.

In her dissent, Justice Sonia Sotomayor wrote that upholding the President's executive order runs counter to the Constitution's First Amendment and its promise of religious liberty and religious neutrality. "The majority here completely sets aside the President's charged statements about Muslims as irrelevant," she wrote.

"That holding erodes the foundational principles of religious tolerance that the court elsewhere has so emphatically protected, and it tells members of minority religions in our country 'that they are outsiders, not full members of the political community,'" Justice Sotomayor wrote.

As described by Rep. Keith Ellison (D-MN), the first Muslim elected to Congress, the ruling gives "legitimacy to discrimination and Islamophobia." In light of this appalling ruling, the MFA calls on the public to redouble its efforts to restore America's historic role as a land of decency, religious freedom and tolerance and to press the Congress to take a leadership role.

The Muslim ban does not represent the welcoming communities across the United States. I urge Congress to exert oversight and accountability over the administration and ensure no federal taxpayer dollars are used to implement the Muslim ban. My community welcomes our immigrant, refugee, and Muslim neighbors, and I call on you to do the same."
